NOTICE PURSUANT TO SECTION 29 OF THE TRUSTEE ORDINANCE  (CHAPTER 29)

In pursuance of Sections 29, 56 and 62 of the Trustee Ordinance (Cap. 29 of the Laws of Hong Kong) and In the matter of YUE XIU FUTURES COMPANY LIMITED (越秀期貨有限公司) (the “Company”)

NOTICE IS HEREBY GIVEN that the Company has ceased its businesses and operations on 31st December 2021 and intends to distribute assets held by the Company on behalf of its clients and to make payment into court under Section 62 of the Trustee Ordinance (Cap. 29 of the Laws of Hong Kong) (“Trustee Ordinance”) in respect of all unclaimed cash/funds/assets held in existing clients’ accounts.

AND TAKE FURTHER NOTICE that any person who claims to hold, be entitled to and/or otherwise interested in any cash/funds/assets in an account with the Company (“Trust Assets”) is required to send to the Company by 25th November 2022 (“Bar Date”) the full particulars of its/his/her claim in respect of the Trust Assets which shall be in writing, signed by the client and served on the Company by post/facsimile/email.

Such claim particulars shall state the full name, account no., telephone no. and the manner of withdrawal of the cash/funds/assets (for instance, by cheque, transfer or telegraphic transfer, together with the necessary payment instructions (if any)).

AND TAKE FURTHER NOTICE that at the expiration of the said Bar Date the Company will be permitted, to the extent that the Company is satisfied there exist no valid and enforceable security interests in particular Trust Assets in favour of any party (including the Company), distribute those Trust Assets or any part thereof to and among the persons considered by the Company to be entitled thereto, having regard only to the claims of which the Company then have notice. Trust Assets will, however, be distributed to those entitled as known to the Company at the time of distribution and, pursuant to Section 29 of the Trustee Ordinance, the Company will not, as respects the Trust Assets so distribute, be liable to any person of whose claim the Company have not, at the time of distribution, had notice.

AND FURTHER TAKE NOTICE that persons who do not make claims to Trust Assets by the Bar Date may lose their entitlement, if any, to share in any distribution of the Trust Assets, and all unclaimed cash/funds/assets will be paid into Court.
